Arrests and Courts, May 10 edition

The following are brief listings from the May 10 print edition of the Livingston County News “Record” page. All individuals listed below are innocent until proven guilty, unless otherwise noted.

Arrests

Assault

Lon F. Jarrell, Jr., 57, of Lima was arrested for Assault III° on May 2 by LCSO. Following arraignment in Lima Town Court, Jarrell was remanded to the Livingston County Jail in lieu of $200 cash bail/$400 property bond. Jarrell will return to Lima Town Court.

Sex crime

Andrew Congdon, 21, of Mount Morris was arrested April 30 by Geneseo PD on a Superior Court Warrant of Arrest signed by Livingston County Judge Robert Wiggins. Allegedly, Congdon sexually assaulted a female in a residence on Court Street. The arrest warrant was issued after an investigation into allegations of a sexual assault was made, and a grand jury filed an indictment against Congdon. The arrest warrant listed the charges of Rape I°, Rape III°, Sexual Abuse III°, and three counts of Unlawful Dealing with a Child I°. Congdon was stopped on a traffic stop and taken into custody on the arrest warrant. Congdon was processed and turned over to Livingston County Court for arraignment.

Clinton P. Seiwell, 20, of Dalton was charged April 20 by LCSO with Sexual Abuse III°. Siewell will appear in Dansville Village court to answer charges.

Luis Santos, 17, of Geneseo was arresed May 1 by Geneseo PD for Forcible Touching, Sexual Abuse III° and Public Lewdness. Allegedly, Santos engaged in sexual behavior with a 15-year-old female. Santos was arraigned in front of Geneseo Justice Thomas Bushnell and released to appear at a later date. An order of protection was issued for the victim.

Drugs

Christopher A. Mosher, 17, of Hemlock was arrested April 26 by LCSO for Criminal Possession of a Controlled Substance. Mosher will answer charges in Livonia Town Court.

Chaz T. Santucci, 24, of Honeoye Falls was arrested April 29 by LCSO for Criminal Possession of a Hypodermic Instrument, Criminal Possession of a Controlled Substance VII°, Aggravated Unlicensed Operation of a Motor Vehicle II°, Unlawful Possession of Marijuana, Unlicensed Operator and Inadequate Exhaust. Ethan J. Mitchell, 24, of Dansville, a passenger in the Santucci vehicle, was charged with Criminal Possession of a Hypodermic Instrument. Both Santucci and Mitchell will report to Geneseo Village Court to answer charges.

Omar M. Ahmed, 19, of Williamsville was charged with Criminal Sale of Marijuana and Unlawful Possession of Marihuana on April 24 by LCSO. Following arraignment in Geneseo Village Court, Ahmed was remanded to the Livingston County Jail in lieu of $500 cash bail/$1,000 property bond. Ahmed will return to Geneseo Village Court.

Drunk driving

Joseph J. Fahey, 24, of Leicester was charged with Driving While Intoxicated, Blood Alcohol Content .08 percent or Greater and Speeding on April 29 by LCSO. Fahey will report to Leicester Town Court.

Dustin Mulcahey, 24, of Honeoye Falls was arrested May 5 by Geneseo PD for Driving While Intoxicated and Driving having with more than .08 percent blood alcohol content. Mulcahey is scheduled to appear in Geneseo Village Court on May 22.

Weapons

Justin P. Scott, 24, of Mount Morris was charged with Criminal Possession of a Weapon on April 28 by LCSO. Scott will address charges in Mount Morris Village Court on a later date.

Erich N. Avedisian, 48, of Geneseo was charged with Criminal Possession of a Weapon III° on May 1 by LCSO. Avedisian will answer charges in Geneseo Village Court.

License and registration

Frank Baumgardner, 30, of West Henrietta was arrested May 4 by Geneseo PD for Aggravated Unlicensed Operation II°. Allegedly, Baumgardner was driving while having one suspension and three revocations on his driver’s license. Baumgardner is scheduled to appear in Geneseo Village Court on June 6.

Tyler Rakestran, 27 from Lima was arrested May 4 by Geneseo PD for Aggravated Unlicensed Operation III°, Unlicensed Operation, and an Equipment Violation. Rakestran is scheduled to appear in Geneseo Village Court on June 19.

Shane Donohue, 32, arrested for aggravated unlicensed operation motor vehicle III°, circumvent interlock-subject to court order-operate motor vehicle without device, April 17 by Dansville PD.

Britney Barnhardt, 20, was arrested by Mount Morris PD on April 19 for motor vehicle violation: registration suspended, aggravated unlicensed operation or a motor vehicle III°, motor vehicle license violation: no license, operate motor vehicle without insurance.

Justin Cruz-Barnhardt, 29, was arrested April 19 by Nunda PD for aggravated unlicensed operation of a motor vehicle III°, drinking alcohol in motor vehicle on highway, operate motor vehicle on public highway while using mobile phone.

Kevin Deasey, 43, arrested April 14 by Nunda PD for motor vehicle violation: registration suspended.

Theft

Nathan Chau, 19, of Amherst, arrested May 5 by Geneseo PD for Petit Larceny. Chau is scheduled to appear in Geneseo Village Court on June 5.

Other charges

Jordan Kirkpatrick, 21, of Rochester was arrested May 3 by Geneseo PD for Unlawful Dealing with a Child I°, and Daniel Schlant, 20, of Buffalo for Unlawful Possession of Alcohol. Allegedly, the officer heard loud noise coming from an apartment on Hillside Drive, and upon investigating the incident found that Kirkpatrick provided Schlant with alcoholic beverages. Both are scheduled to appear in Geneseo Village Court on May 8.

Eric E. Binnert, 52, of Caledonia was arrested April 28 by LCSO for Criminal Mischief III°. Following arraignment in Livonia Town Court, Binnert was remanded to the Livingston County jail on no bail. Binnert will return to Livonia Town Court for a Felony hearing.

Rebecca S. Polka, 21, of Rush was arrested for Forgery II° and Identity Theft III° on April 27 by LCSO. Polka will appear in York Town Court to answer charges.

Alfred H. Fratter, 64, of Avon was cited for Trespassing on May 2 by LCSO and released on an appearance ticket to Lima Town Court.

Jamie Wolfanger, 28, arrested by Dansville PD for criminal mischief: intent to damage property on April 25.

Tamara Kennedy, 43, arrested by Dansville PD for aggravated harrassment II° and criminal contempt II°: disorderly behavior on April 25.

Augustin Morley, 17, was arrested by Dansville PD for trespassing April 20.

Justin Balicki, 17, was arrested by Dansville PD for trespassing April 20.

Kevin Tobey, 16, was arrested by Dansville PD for trespassing April 20.

Bobbi murphy, 49, was arrested by Dansville PD for trespassing April 20.

Warren Greenough, 40, was arrested by Mount Morris PD on April 22 for being a fugitive from justice, false written statement, and endangering the welfare of a child.

Deserae Heidrick, 16, was arrested April 24 by Mount Morris PD for harassment-III°: physical contact.

Jeffrey Barrows, Jr., was arrested April 22 by Mount Morris PD for harassment II°: physical contact, unlawful imprisonment II°.

In court

After presentation by Eric R. Schiener, Assistant District Attorney, the following cases were handled in the Livingston County Court before the Honorable Robert B. Wiggins on May 1.

MICHAEL J. BELANGER, 45, of Sparta was sentenced to a term of one to three years incarceration in a state correctional facility as a result of a plea of guilty to Aggravated Driving While Intoxicated, a Class E Felony. He was also ordered to pay a fine plus restitution and his license was revoked with a requirement to install an Ignition Interlock Device. He was also sentenced to a concurrent term of one to three years incarceration in a state correctional facility as a result of an admission to a violation of probation.

ROMAN V. MELNIK, 38, of Rochester was sentenced to a term of one to three years incarceration in a state correctional facility to run consecutive to his current sentence as a result of a prior plea of guilty to Bail Jumping II°, a Class E Felony. He was also ordered to pay surcharges.

A YOUTHFUL OFFENDER was arraigned on a violation of probation, entered a denial, and the matter was adjourned to May 8 for further proceedings. He was remanded to the Livingston County Jail without bail.

MARK W. BIONDOLILLO, 41, of Leicester was charged with Criminal Possession of Marijuana II°, a Class D Felony; Unlicensed Growing of the Plant Known as Cannabis, a Class A Misdemeanor; and Endangering the Welfare of a Child, a Class A Misdemeanor. He was arraigned with his attorney, entered a plea of not guilty, and the matter was adjourned to June 12 for further proceedings.

DYLAN M. ELDRIDGE, 16, of Dansville was charged with Burglary III°, a Class D Felony; Petit Larceny, a Class A Misdemeanor; and Criminal Mischief IV°, a Class A Misdemeanor. He was arraigned with his attorney, entered a plea of not guilty, and the matter was adjourned to June 26 for further proceedings. Bail was continued at $2,500.

ANDREW R. CONGDON, 21, of Mount Morris was charged with Rape I°, a Class B Felony; Rape III°, a Class E Felony; Sexual Abuse III°, a Class B Misdemeanor; and three counts of Unlawfully Dealing with a Child I°, a Class A Misdemeanor. He was arraigned with his attorney, entered a plea of not guilty, and the matter was adjourned to May 22 for further proceedings. Bail was set at $10,000 and an Order of Protection was issued for three witnesses.

After presentation by Victor D. Rowcliffe, Assistant District Attorney, the following cases were handled in the Livingston County Court before the Honorable Dennis S. Cohen on May 3.

RICHARD D. FLINT, 45, of Mt. Morris was sentenced to a term of two to four years incarceration in a state correctional facility as a result of a plea of guilty to Attempted Grand Larceny III°, a Class E Felony. He was also ordered to pay surcharges, DNA fees and restitution.

PATRICK J. FORD, 42, of Livonia was sentenced to a term of one to three years incarceration in a state correctional facility as a result of a prior admission to a violation of probation.

PAUL F. RANGERE, 48, of Nunda was sentenced to 15 days incarceration in the Livingston County Jail and five years probation to include six months electronic home monitoring as a result of a prior plea of guilty to Driving While Intoxicated, a Class E Felony. He was also ordered to pay a fine plus surcharges and his license was revoked with a requirement to install an Ignition Interlock Device.

FRANCISCO J. GARCIA-ALBINO, 23, of Perry was charged with Forgery II°, a Class D Felony; Criminal Impersonation II°, a Class A Misdemeanor; and Offering a False Instrument for Filing I°, a Class E Felony. He was arraigned with his attorney, entered a plea of not guilty, and the matter was adjourned to May 31 for further proceedings. Bail was set at $10,000.

DAVID WAMPLER, 40, of Livonia was sentenced to a term of nine years incarceration in a state correctional facility plus two years post-release supervision after a Livingston County Jury convicted him of two counts of Criminal Sale of a Controlled Substance III°, a Class B Felony; one count of Criminal Sale of a Controlled Substance V°, a Class D Felony; two counts of Unlawfully Dealing With a Child I°, a Class A Misdemeanor; and five counts of Endangering the Welfare of a Child, a Class A Misdemeanor. An Order of Protection was issued for each victim, and Mr. Wampler waived his right to appeal. Additionally, the Court ordered that bail in the amount of $17,500 be forfeited because Mr. Wampler did not appear for his trial.

Child Safety

Seat Check Event

The Geneseo Police Department will be conducting a Child Safety Seat Check Event on Thursday, May 10 between 4 p.m. to 8 p.m. at the Geneseo Fire Hall on Center Street in the Village of Geneseo.

No appointment is necessary. If you are unable to make this event, please call Officer Jeffrey Szczesniak or Officer Daniel Piedmonte at the Geneseo Police Department at 243-2420 to schedule an appointment.

The Child Safety Seat Event is funded by the National Highway Traffic Safety Administration with a grant from the New York State Governor’s Traffic Safety Committee.

Memorial Day Impaired Driving Campaign

The Geneseo Police Department is participating in the 2012 Memorial Day Drinking and Driving Campaign. The National event is commencing on May 23 and ending on May 29. The Geneseo Police Department would like to remind motorists not to drink and drive. There are a lot of vehicles on the roadways.

The department will be targeting drunk drivers. According to the National Highway Traffic Safety Institute there is a fatal DWI crash every 39 minutes. Motorists can play a vital role in ensuring safety on our roads.
