Arrests and courts, Aug. 23 edition
The following are brief listings from the Record page of the Aug. 23 Livingston County News print edition. Individuals listed below are innocent until proven guilty.
Arrests
Drunk Driving
Dylan Nourse, 20, of Castile was arrested by Geneseo PD Aug. 18 for Driving While Intoxicated, Aggravated Driving While Intoxicated, Unlawful Possession of Marihuana, and Failure to Signal on Main Street. Dylan is scheduled to appear in Geneseo Village Court at a later date.
Theft
Ashley Cardona, 24, of Geneseo was arrested by Geneseo PD Aug. 18 for Petit Larceny . Allegedly, Cardona stole merchandise from a store. Cardona is scheduled to appear in Geneseo Village Court on Sept. 4.
Harassment
Jordan Porcelli, 25, charged by Avon PD for harassmentII°: physical contact on Aug. 5.
License and Registration
Andrew Rogers, 22, was arrested by Caledonia PD for an equipment violation: exhaust system, as well as aggravated unlicensed operation of a motor vehicle III° on Aug. 11.
Other charges
James Johnson, 23, of Rochester, was arrested by Geneseo PD on Aug. 17 on a bench warrant for failing to appear in Geneseo Village Court on an Assault III°. Johnson was located by Deputy Clarke and turned over to the Geneseo Police Department for arraignment. Johnson was arraigned in front of Geneseo Justice Thomas Bushnell and released to appear at a later date. Johnson also had an outstanding bench warrant from the Rochester Police Department for Arson IV°. Johnson was turned over to the Rochester Police Department for arraignment on their warrant.
Heather Louvullo, 23, was arrested by Caledonia PD for unlawful possession of marijuana and criminal possession of stolen property V° on July 30.
Matthew Bernard, 29, was arrested by Nunda PD for criminal contempt II°: disobey court, harassment-II°: physical contact on July 27.
In court
After presentation by Gregory J. McCaffrey, District Attorney, the following cases were handled in the Livingston County Court before the Honorable Robert B. Wiggins on Aug. 14.
ERIK D. ADAMSON, 38, of Geneseo was sentenced to one year incarceration in the Livingston County Jail and five years probation to include 800 hours community service as a result of a prior plea of guilty to Driving While Intoxicated, a Class D Felony. He was also ordered to pay a fine, surcharges, and his license was revoked with a requirement to install an Ignition Interlock Device.
CHRISTOPHER M. BAROODY, 25, of Mount Morris was sentenced to four months intermittent incarceration in the Livingston County Jail and five years probation as a result of a prior plea of guilty to Driving While Intoxicated, a Class E Felony. He was also ordered to pay a fine, surcharges, and his license was revoked with a requirement to install an Ignition Interlock Device.
ERIC E. BINNERT, 53, of Caledonia was arraigned on a violation of probation, entered a denial, and the matter was adjourned to Sept. 11 for further proceedings.
SAMUAL A. DIAZ, 20, of Dansville was sentenced to time served and three years probation as a result of a plea of guilty to Attempted Criminal Mischief III°, a Class A Misdemeanor. He was also ordered to pay restitution plus surcharges.
TARA K. HAWKINS, 35, of Rochester was sentenced to six months incarceration in the Livingston County Jail and five years probation as a result of a plea of guilty to Grand Larceny IV°, a Class E Felony. She was also ordered to pay surcharges and restitution.
SUSANNE M. HENZEL, 39, of Honeoye Falls was sentenced to continue probation plus perform 500 hours community service as a result of a prior admission to a violation of probation.
PHILLIP J. JOHANTGEN, 28, of Mt. Morris was sentenced to one year incarceration in the Livingston County Jail as a result of a prior plea of guilty to Sex Offender Failure to Register or Verify, a Class E Felony. He was also ordered to pay surcharges.
MICHAEL L. MORAN, 32, of Dansville was sentenced as a second felony offender to a term of four years incarceration in a state correctional facility plus five years post-release supervision as a result of a plea of guilty to Strangulation II°, a Class D Felony; and an admission to a violation of probation. He was also ordered to pay surcharges and DNA fees. An Order of Protection was issued for the victim.
MICHAEL D. PRAGLE, 25, of Wayland was sentenced as a second felony offender to a term of one and one-half to three years incarceration in a state correctional facility as a result of a plea of guilty to Attempted Burglary III°, a Class E Felony. He was also ordered to pay restitution plus surcharges.
JAMIE J. WOLFANGER, 28, of Dansville was charged with Criminal Contempt I°, a Class E Felony; Criminal Trespass II°, a Class A Misdemeanor; Menacing II°, a Class A Misdemeanor; Tampering with a Witness IV°, a Class A Misdemeanor; and Harassment II°. He was arraigned with his attorney, entered a plea of not guilty, and the matter was adjourned to Sept. 25 for further proceedings. Bail was continued at $7,000. An Order of Protection was issued for the victim.
After presentation by Victor D. Rowcliffe, Assistant District Attorney, the following cases were handled in the Livingston County Court before the Honorable Dennis S. Cohen on August 16, 2012.
CATHY J. BARNHART, 47, of Livonia was sentenced to a term of one to three years incarceration in a state correctional facility as a result of a prior plea of guilty to Grand Larceny IV°, a Class E Felony. She was also ordered to pay surcharges, DNA fees, and restitution.
CALEB M. STROBEL, 20, of Mount Morris was sentenced to six months incarceration in the Livingston County Jail and five years probation to include Drug Treatment Court as a result of a plea of guilty to Attempted Burglary II°, a Class D Felony. He was also ordered to pay surcharges and DNA fees.
JOSEPH C. MOSHER, 34, of Lakeville was charged with Felony Failure to Register or Verify Address with Sex Offender Registry, a Class E Felony; Endangering the Welfare of a Child, a Class A Misdemeanor; and Harassment II°. He was arraigned with his attorney, entered a plea of not guilty, and the matter was adjourned to Sept. 27 for further proceedings. An Order of Protection was issued for the victim.
NICOLE M. SCARLATA, 26, of Rochester was sentenced to time served and five years probation as a result of a plea of guilty to Grand Larceny IV°, a Class E Felony; and Driving While Ability Impaired by a combination of Drugs and Alcohol, a Misdemeanor. She was also ordered to pay a fine, surcharges, DNA fees, and restitution. Her license was revoked with a requirement to install an Ignition Interlock Device.
