The following are brief listings from the Record page of the Livingston County News Sept. 13 print edition. People listed here are innocent until proven guilty.

Arrests

Assault

Trevor Cliff, 21, arrested for assault III°: with intent to cause physical injury, assault III°: recklessly cause physical injury by Avon PD Aug. 13

Drugs

Dustin T. Swift, 20, of Conesus was arrested for Criminal Possession of a Controlled Substance VII° and Unlawful Possession of Marijuana on Aug. 29 by LCSO. Swift will address charges in Livonia Town Court.

Jeremiah W. Lippincott, 26, and Shawn J. Kanaval, 27, both of Wayland,were arrested Aug. 31 by LCSO for Criminal Possession of a Controlled Substance VII° and Unlawful Possession of Marijuana. Lippincott and Kanaval will answer charges in Geneseo Town Court on a later date.

Daniel E. Bruinsma, 66, of Mount Morris was arrested Sept. 6 by LCSO for Unlawful Growing of Cannabis. Bruinsma will appear in Mount Morris Town Court to address charges.

Drunk Driving

Michael A. Basta, 45, Rochester was arrested Aug. 31, charged with Driving While Intoxicated, Refusal To Submit To A Breathalyzer Test, Consumption of Alcohol in a Motor Vehicle, Improper/No Signal, Following Too Closely, Failure To Dim Headlights and Unsafe Lane Change by LCSO. Following arraignment, Basta was committed to the Livingston County Jail in lieu of $2,000 cash bail/$3,000 property bond. Basta will answer charges in Groveland Town Court.

Blake E. Peaty, 24, of Dansville was arrested Sept. 1 by LCSO for Driving While Intoxicated, Aggravated Driving While Intoxicated, Blood Alcohol Content .18 percent or Greater and Failure To Stop at a Stop Sign. Peaty will appear in Ossian Town Court to answer charges.

Elizabeth Gavett, 27, of Lakeville was arrested by Geneseo PD for Driving While Intoxicated, Driving with more than .08 percent blood alcohol content, Aggravated Unlicensed Operation III°, Driving with a Suspended Registration, Unlawful Possession of Marihuana, Unlicensed Operation, Failure to Keep Right, and Uninsured Motor Vehicle on Mount Morris Road. Gavett is scheduled to appear in Geneseo Village Court on Oct. 9.

Michele E. Feeley, 45, of Linwood was charged Sept. 2, with Driving While Intoxicated, Aggravated Driving While Intoxicated, Blood Alcohol Content .18 percent or Greater and Unsafe Lane Change. Feeley will answer charges in Livonia Town Court.

Jaclyn Brown, 18, arrested by Avon PD for aggravated DWI: .18 of one percent or more alcohol in blood-no priors, driving while intoxicated-first offense, operating vehicle after consuming alcohol less than 21, speed not reasonable and prudent, moved from lane unsafely on Aug. 23.

Carl Alverson, 42, arrested by Dansville PD for DWI: previous conviction of designated offense within 10 years, illegal signal: from parked position, failure to keep right: two lane road, refusal to take breath test, improper left turn: two way road on August 25.

License and registration

Michael Sanchez, 20, arrested for speeding, aggravated unlicensed operation II°: three/more open suspensions-three/more separate dates by Caledonia PD on Sept. 1.

John Cupicha, 42, arrested for aggravated unlicensed operation of a motor vehicle III°, motor vehicle violation: registration suspended, motor vehicle license violation: no license, operate motor vehicle when license/registration suspended under article seven, failed to use headlights with windshield wipers by Dansville PD on Aug. 14.

David Danelle, 24, arrested for aggravated unlicensed operation of a motor vehicle- III°, motor vehicle violation: registration suspended, operate motor vehicle when license/registration suspended under article seven, motor vehicle license violation: no license, license restriction violation, failure to obey traffic control device Aug. 18 by Dansville PD.

William Henry, 21, arrested for aggravated unlicensed operation of a motor vehicle III° by Mount Morris PD on Aug. 25

Other charges

Todd L. Semmler, 43, Livonia, was charged with two counts of Disorderly Conduct by LCSO on Sept. 3. Semmler will appear in Livonia Town Court to address charges.

Robbie C. Hamilton, 25, of Middlesex was charged with Harassment II° by LCSO Sept. 1. Hamilton will report to Dansville Town Court to address charges.

Kyle R. Sage, 20, of Hemlock, was charged with Menacing II° and Endangering The Welfare of a Child by LCSO on Sept. 5. Following arraignment in Lima Town Court, Sage was remanded to the Livingston County Jail in lieu of $250 cash bail. Sage will return to Lima Town Court to answer charges on a later date.

Christopher M. Mitchell, 27, Nunda, NY, was arrested September 4, charged with two counts of Harassment 2ndDegree and one count of Endangering The Welfare of a Child. Mitchell will answer charges in West Sparta Town Court on a later date.

Ricky Polizzi, 41, arrested by Avon PD for unauthorized use of a vehicle III°, Sept. 5.

David Pratt, 66, arrested for menacing III° by Dansville PD on Aug. 25.

Joseph Fletcher, 46, arrested by Mount Morris PD for disorderly conduct: unreasonable noise, harassment- II°: physical contact, resisting arrest, disorderly conduct: fight/violent behavior on Aug. 8.

Letha Pipes, 26, arrested by Mount Morris PD for false written statement, Aug. 13.

Carl Liddy, 20, arrested by Mount Morris PD for petit larceny, criminal mischief: intent to damage property on Aug. 14.

Cassi Vandame, 28, arrested by Mount Morris PD for harassment II°: physical contact, Aug. 26.

In court

After presentation by Gregory J. McCaffrey, District Attorney, the following cases were handled in the Livingston County Court before the Honorable Robert B. Wiggins Aug. 28.

CHRISTOPHER OCHSENHIRT, 49, of Conesus was sentenced to four months intermittent incarceration in the Livingston County Jail and five years probation as a result of a prior plea of guilty to Criminal Contempt I°, a Class E Felony. He was also ordered to pay surcharges and an Order of Protection was issued for the victim.

JAMIE K. BURKE, 19, of Rochester was charged with Burglary III°, a Class D Felony; and Grand Larceny IV°, a Class E Felony. She as arraigned with her attorney, entered a plea of not guilty, and the matter was adjourned to Oct. 30 for further proceedings. Bail was continued at $5,000.

MARCUS J. GREENE, 34, of Rochester was sentenced to six months incarceration in the Livingston County Jail as a result of a plea of guilty to Aggravated Unlicensed Operation of a Motor Vehicle I°, a Class E Felony. He was also ordered to pay a fine plus surcharges.

CANDIDO D. TUCKER, 19, formerly of the Groveland Correctional Facility was charged with two counts of Assault I°, as Class B Felony; two counts of Assault II°, a Class D Felony; and Promoting Prison Contraband I°, a Class D Felony. He was arraigned with his attorney, entered a plea of not guilty, and the matter was adjourned to Sept. 25 for further proceedings. Bail was set at $50,000.

KEVIN R. MULVANEY, 56, of Livonia was charged with Driving While Ability Impaired by Drugs, a Class E Felony. He was arraigned with his attorney, entered a plea of not guilty, and the matter was adjourned to Oct. 9 for further proceedings. Bail was continued at $5,000.

After presentation by Victor D. Rowcliffe, First Assistant District Attorney, the following cases were handled in the Livingston County Court before the Honorable Dennis S. Cohen on Aug. 30.

BENJAMIN D. BAREFOOT, 24, of Caledonia sentenced to four months intermittent incarceration in the Livingston County Jail and five years probation to include three months electronic home monitoring as a result of a prior plea of guilty to Driving While Intoxicated, a Class E Felony. He was also ordered to pay a fine plus surcharges and his license was revoked with a requirement to install an Ignition Interlock Device.

MATTHEW M. GIUSEPPETTI, 17, of Lakeville was charged with Burglary III°, a Class D Felony; and Petit Larceny, a Class A Misdemeanor. He was arraigned with his attorney, entered a plea of not guilty, and the matter was adjourned to Oct. 11 for further proceedings. Bail was continued at $1,000.

NICHOLAS J. HELLIS, 23, of Rochester entered a plea of guilty to Attempted Criminal Possession of a Weapon II°, a Class D Felony; and the matter was adjourned to Oct. 11 for sentencing. He was remanded to the Livingston County jail without bail.

ANDREW SULLIVAN, 28, of Dansville was sentenced to a term of three years’ incarceration in a state correctional facility plus ten years post-release supervision as a result of a plea of guilty to two counts of Rape III°, a Class E Felony. He was also ordered to pay surcharges, DNA fees, and Sex Offender Registry Fees. An eight-year Order of Protection was issued for the victim.

After presentation by Gregory J. McCaffrey, District Attorney, the Livingston County Grand Jury handed up indictments on the following individuals on Sept. 5.

KIRK M. BROCKMAN, 35, of Honeoye was charged with Driving While Intoxicated, a Class E Felony; Aggravated Unlicensed Operation of a Motor Vehicle I°, a Class E Felony; Leaving the Scene of a Property Damage Accident; and Possession of an Open Alcoholic Beverage in a Motor Vehicle.

HEATHER L. JERGE, 29, of Houghton was charged with Aggravated Unlicensed Operation of a Motor Vehicle iI°, a Class E Felony; Driving While Intoxicated, as a Misdemeanor; and Speeding.

SAM SIDES JR., 38, of Rochester was charged with Burglary II°, a Class C Felony; Grand Larceny III°, a Class D Felony; and Grand Larceny IV°, a Class E Felony.

LANDIS E. WINDOM, 25, of Rochester was charged with Burglary II°, a Class C Felony; Grand Larceny III°, a Class D Felony; and Grand Larceny IV°, a Class E Felony.
