Arrests and courts, week of Oct. 18

The following are arrest and court listings received by the Livingston County News during the week of Oct. 18. The County News prints listings sent by the Livingston County District Attorney’s Office, the Livingston County Sheriff’s Office, New York State Police, and local police agencies. We print all misdemeanor and felony listings we receive within a month of the arrest. All individuals below are innocent until proven guilty.

Arrests

Theft

Shawn M. Stenglein, 27, of Canandaigua, and Jeffrey A. Boula, 25, of Rochester were arrested Oct. 7 by LCSO for Criminal Possession of Stolen Property III°, Burglary III° and Petit Larceny. Following arraignment in York Town Court, Stenglein and Boula were remanded to the Livingston County Jail in lieu of $25,000 cash bail/$50,000 property bond and will return to York Town Court for a felony hearing .

Richard D. Hammer, 45, Daniel J. Wolfe, 38, Amy Lynn Showler, 37, and Jennifer A. Zimblis, 40, all of Batavia, were charged with Grand Larceny IV° on Oct. 8 by LCSO. Following arraignment in Caledonia Village Court, Hammer and Wolfe were committed to the Livingston County Jail on no bail. Showler was held on $7,500 cash bail/ $15,000 property bond and Zimblis on $5,000 cash bail/$10,000 property bond. All four will return to Caledonia Village Court.

Kayce Page, 33, was arrested for petit larceny by Dansville PD on Sept. 30.

Drugs

Holly Phillips, 41, was arrested for unlawfully growing cannabis and unlawful possession of marijuana by Dansville PD Sept. 26.

Harassment

Jacob R. Szczech, 25, of Caledonia was charged with Harassment II° on Oct. 7 by LCSO. Szczech will address charges in Caledonia Village Court.

Travis M. Abbott, 26, of Silver Springs was charged with Harassment II° on October 5. Abbott was released on an appearance ticket to report to Leicester Town Court to answer charges.

License and Registration

William Vanderhorst, 24, of Geneseo for Aggravated Unlicensed Operation III°, Unlicensed Operation, and Disobeying a Traffic Control Device On Oct. 6 by LCSO. Vanderhorst is scheduled to appear in Geneseo Village Court on Oct. 23.

Brett Smith, 49, of Nunda was arrested for Aggravated Unlicensed Operation III°, Unlicensed Operation and an Equipment Violation on Oct. 6 by LCSO. Smith is scheduled to appear in Geneseo Village Court on Oct. 23.

Catherine Cratsley, 28, of Geneseo for Aggravated Unlicensed Operation III° and Unlicensed Operation on Oct. 10 by Geneseo PD. Cratsley is scheduled to appear in Geneseo Village Court on Nov. 27.

Matthew Mead, 43, of Perry, was arrested Oct. 12 by Geneseo PD for Aggravated Unlicensed Operation III°, Unlicensed Operation, an Equipment Violation, and Unlawful Possession of Marijuana by Geneseo PD on Oct. 12. Allegedly, Mead’s license was suspended for failing to pay child support and he was in possession of marihuana. Mead is scheduled to appear in Geneseo Village Court on Nov. 20.

Adrian Alexander, 32, of Geneseo was arrested for Aggravated Unlicensed Operation III°, Unlicensed Operation, Uninsured Motor Vehicle, Uninspected Motor Vehicle, and Driving with a Suspended Registration by Geneseo PD on Oct. 12. Alexander is scheduled to appear in Geneseo Village Court on Nov. 20.

David Tomassetti, 54, was arrested by Avon PD aggravated unlicensed operation of a motor vehicle III°, operating a motor vehicle without inspection, unsafe turn or failure to give appropriate signal, no seat belt of Sept. 28.

Other charges

Joanne L. Young, 41, Wayland, NY, was arrested Oct. 9 by LCSO, charged with Animal Cruelty. Young will address charges in Springwater Town Court.

Hunter J. Kamlay, 18, of Lakeville was arrested and charged with Burglary III°, Criminal Mischief III° and Arson IV° on Oct. 9 by LCSO. Following arraignment in Livonia Town Court, Kamlay was remanded to the Livingston County Jail in lieu of $1,000 cash bail. Kamlay will return to Livonia Town Court to address charges.

Shelby C. Hoag, 17, of Dansville was arrested for Unlawfully Dealing With a Child, Endangering The Welfare of a Child and Unlawful Possession of Alcohol on Oct. 7 by LCSO. Hoag will appear in North Dansville Town Court to address charges on a later date.

Roger L. Ricks, Jr., 42, Caledonia was charged Oct. 9 with two counts each of Menacing II° and Endangering The Welfare of a Child by LCSO. Following arraignment in Caledonia Town Court, Ricks was remanded to the Livingston County Jail in lieu of $750 cash bail/$1,500 property bond. Ricks will return to Caledonia Town Court.

Austin Reiss, 21, of Phoenicia, was arretsed for Passing a Stopped School Bus Oct. 10 by Geneseo PD. Reiss is scheduled to appear in Geneseo Village Court on Nov. 20.

Adam Webster, 17, was arrested by Dansville PD for Criminal Trespassing III° on Sept. 22.

Serious pedestrian accident in York

On Oct. 15, the New York State Police in Geneseo were dispatched to a vehicle/pedestrian accident involving three tractor trailers were driving north on Route 63 in the Town of York

The trucksstopped prior to proceeding underneath a railroad overpass. A driver in one of the tractor trailers, identified as Brian Scott, 45, of Trenton, N.J. and a passenger, identified as Jabril M. Jama 24, of Seattle, Wash. were standing in the southbound lane making sure there was enough clearance for the first tractor trailer to clear the overpass.

As the second tractor trailer passed under the overpass, a 2004 Dodge Caravan traveling south on Route 63 did not observe Brian Scott in the road and strikes him in the left elbow with the passenger side mirror. Scott is uninjured.

The van then continued south on Route 63 and struck Jabril Jama.

Jama was medevaced to Strong Memorial Hospital with head trauma and a broken leg and is currently in guarded condition.

The New York State Police reconstruction team responded and have ruled out speed and alcohol as a factor. The investigation is continuing.

In Court

After presentation by Gregory J. McCaffrey, District Attorney, the following cases were handled in the Livingston County Court before the Honorable Robert B. Wiggins on October 9, 2012. 

JEFFREY N. BENJAMIN, 24, of Mt. Morris was sentenced to two months intermittent incarceration in the Livingston County Jail and five years probation as a result of a prior plea of guilty to Driving While Intoxicated, a Class E Felony. He was also ordered to pay a fine plus surcharges and DNA fees. His license was revoked with a requirement to install an Ignition Interlock Device.

A YOUTHFUL OFFENDER was sentenced to a term of one to three years incarceration in a state correctional facility as a result of a plea of guilty to four counts of Burglary in the Third Degree, a Class D Felony; Grand Larceny in the Fourth Degree, a Class E Felony; Criminal Mischief in the Fourth Degree, a Class A Misdemeanor; and Petit Larceny, a Class A Misdemeanor. He was also ordered to pay surcharges and restitution.

KEVIN R. MULVANEY, 56, of Livonia was sentenced to 100 hours community service and five years probation as a result of plea of guilty to Driving While Ability Impaired by Drugs, a Class E Felony. He was also ordered to pay a fine, surcharges, and DNA fees.

After presentation by Victor D. Rowcliffe, First Assistant District Attorney, the following cases were handled in the Livingston County Court before the Honorable Dennis S. Cohen on October 11, 2012.

A YOUTHFUL OFFENDER was sentenced to four months intermittent incarceration in the Livingston County Jail and three years probation as a result of a plea of guilty to Criminal Trespass in the Second Degree, a Class A Misdemeanor. He was also ordered to pay surcharges.

NICHOLAS J. HELLIS, age 23, of Rochester was charged with Assault in the Second Degree, a Class D Felony. He was arraigned with his attorney, entered a plea of not guilty, and the matter was adjourned to October 18, 2012 for further proceedings. Bail was set at $5,000.00.

 

NICOLE C. HENDRICKSON, 27, of Lima was sentenced to a term of one to three years incarceration in a state correctional facility upon a prior admission to a violation of probation.

CHRISTOPHER R. THOMPSON, 26, of Lima was charged with Grand Larceny in the Fourth Degree, a Class E Felony. He was arraigned with his attorney, entered a plea of not guilty, and the matter was adjourned to October 18, 2012 for further proceedings. Bail was set at $5,000.00.

SAMUEL J. INGALLINA, 43, of Livonia was charged with Aggravated Driving While Intoxicated, a Class D Felony; Aggravated Driving While Intoxicated with a Child Passenger, a Class E Felony; two counts of Endangering the Welfare of a Child, a Misdemeanor; and Operating an Uninspected Motor Vehicle. He was arraigned with his attorney, entered a plea of not guilty, and the matter was adjourned to December 12, 2012 for further proceedings. A temporary Order of Protection was issued for the victim and bail was set at $5,000. Additionally, his license was suspended pending prosecution.

JEFFREY A. ROCK, 23, of Mt. Morris was sentenced to four months intermittent incarceration in the Livingston County Jail and three years probation as a result of a prior plea of guilty to Assault in the Third Degree, a Class A Misdemeanor; and Endangering the Welfare of a Child, a Class A Misdemeanor. He was ordered to pay surcharges and DNA fees; and an Order of Protection was issued for the victim.
